Understanding the difference between encroachment and easement is important in knowing when someone has violated the property rights of a neighbor.

Easement is a written agreement between two parties in which one person allows another to use a part of their property.

Encroachment is akin to trespassing, as it happens when one party builds beyond another personโ€™s private property line. It also happens when someone blocks or intrudes upon part of anotherโ€™s property. When encroachment occurs when a structure is extended onto public land, itโ€™s known as structural encroachment.

If a neighbor refuses to rectify an encroachment, legal action may be necessary, especially because if an encroachment is not acted upon in a timely manner, adverse possession may come into play.
