Understanding the difference between encroachment and easement is important in knowing when someone has violated the property rights of a neighbor.
Easement is a written agreement between two parties in which one person allows another to use a part of their property.
Encroachment is akin to trespassing, as it happens when one party builds beyond another personโs private property line. It also happens when someone blocks or intrudes upon part of anotherโs property. When encroachment occurs when a structure is extended onto public land, itโs known as structural encroachment.
If a neighbor refuses to rectify an encroachment, legal action may be necessary, especially because if an encroachment is not acted upon in a timely manner, adverse possession may come into play.
