Elder Abuse Restraining Orders

Restraining orders for the elderly act in the same manner as other restraining orders. They are meant to protect an elderly adult from anyone who may be physically or emotionally abusing them. Acquiring a restraining order can keep the abuser from being near the abused or force the abuser to move out of the abusee’s house.

Elders may qualify for several types of restraining orders, including:

  • Order of Protection, which legally bars a person from committing any type of domestic violence against you.
  • Emergency Order of Protection, which is an Order of Protection that can be given verbally if you are in eminent physical danger. May not be issued if the Abuse is financial.
  • Release Order, which protects you from someone who has been arrested for domestic violence and then released.
  • Injunction Against Harassment, which grants the bearer protection against any type of harassment.
